HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9056 of 2016 ORDER:

This petition is filed by the petitioners - Accused Nos.2 to 6 under Section 438 of Criminal Procedure Code seeking to grant anticipatory bail to them in Crime No.103 of 2016 of Shamshabad Police Station, Cyberabad, registered for the offences punishable under Sections 323, 506 r/w.34 IPC and 3 (1) (x) (xv) of the SC & ST (PoA) Act.

Heard and perused the material available on record. The allegations against the petitioners are that they trespassed into the house of the de facto complainant and abused her in the name of her caste and also abused her in filthy language with regard to some petty dispute.

Learned counsel for the petitioners submitted that the petitioners are innocent of offences alleged against them and they were falsely implicated in the case.

Learned Additional Public Prosecutor opposed this petition by submitting that there is a bar under the provisions of the SC & ST Act, for grant of anticipatory bail.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioners.
