HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23800 of 2008 ORDER:

The writ petition is filed questioning the order dated 25.10.2008, passed by the 1st respondent without having any jurisdiction. It is the case of the petitioner that by proceedings dated 02.09.2008, the Deputy Commissioner, Endowment, Visakhapatnam had appointed one Sri K. Srinivasa Rao as Single Trustee of Sri Krishna Temple, North Extension, Seethammadhara, Visakhapatnam and the said Krishna Rao was working as a Manager of Sri Venkateswara Swami Temple, Lawsonsbay colony, Visakhapatnam. Challenging the same, the petitioner filed the present writ petition.

Smt K. Lalitha, learned Government Pleader for Endowment submits that the very appointment itself is for a period of two years and though the petitioner had given a letter on 30.10.2008 to the Commissioner that he would hand over the charge within three days, he did not do so and filed the present writ petition.

This Court granted stay of all further proceedings. Inasmuch as of date, the petitioner is continuing and in the event circumstances warrant, the respondents would take necessary steps.

In the facts of the case, as the Manager appointed had not taken charge and as of date there is no proposal for appointment of a Manager, the writ petition is closed leaving it open to the respondents-authorities to take appropriate steps, if situation warrants as of date as per law. No order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
