HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3791 OF 2016 ORDER:

The present Criminal Petition is filed under Section 440 (2) of the Code of Criminal Procedure, 1973, seeking modification of the order dated 08.03.2016 passed in Crl.M.P.No.264 of 2016 on the file of the VIII Additional District and Sessions Judge, Vijayawada.

By an order dated 08.03.2016, the petitioner was released on bail on his executing a personal bond for Rs.50,000/- with two sureties for a like sum each to the satisfaction of the III Additional Chief Metropolitan Magistrate, Vijayawada and on further condition that the petitioner shall attend before the Station House Officer, Governorpet on once in every 15 days until investigation is completed and also cooperate with the investigating officer in respect of the investigation.

Learned counsel for the petitioner submits that the though the order came to be passed on 08.03.2016, till today the petitioner could not get himself released on bail as it is difficult for him to get two sureties for such huge amount.

Having regard to the facts and circumstances of the case, I deem it appropriate to modify the said order. Accordingly, the Criminal Petition is allowed and the condition imposed on the petitioner in Crl.M.P.No.264 of 2016 on the file of the VIII Additional District and Sessions Judge, Vijayawada is hereby modified as under:-

The petitioner shall execute a personal bond of Rs.15,000/- with two local sureties for the like sum each instead of a personal bond for Rs.50,000/- with two sureties for the like sum each. The other conditions mentioned in the said order shall remain unaltered. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
