THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26022 of 2018 ORDER:

Heard Mr.E.V.V.S.Ravi Kumar for petitioner and the learned Assistant Government Pleader for Revenue.

The present writ petition is filed aggrieved by the order of 2nd respondent in proceedings Rc.No.2935/ 2018/ E, dated 24.06.2018, whereunder the 2nd respondent while admitting the revision petition declined to grant stay of operation of order of 3rd respondent. The 3rd respondent through order dated 20.01.2018 ordered for necessary changes in web land of Ganthimarri Village for Sy.No.443-1. Aggrieved by the said order, the revision was filed before the 2nd respondent. The 2nd respondent admitted the revision but declined the prayer for stay of the order impugned before him.

This Court is of the view that the impugned order refers to prima facie case made out for taking the revision on file and while treating the prayer for stay, it is observed that no grounds are made out.

Firstly, the reasons stated by 2nd respondent for refusing the stay application are unconvincing. Secondly, it is in the fitness of things that the status-quo vis-à-vis the subject matter of litigation before the 2nd respondent has to be preserved during pendency of revision. In stead of allowing the Tahsildar to make changes and

thereafter if the revision is allowed again reversing all the entries, this Court is of the view that the stay as prayed for ought to have been granted by the 2nd respondent .

Hence there shall be stay of order dated 20.01.2018 passed by the 3rd respondent during pendency of revision. The 2nd respondent considers and disposes of the revision as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order.

The writ petition is ordered accordingly. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 26.07.2018 Prv
