THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11792 of 2025 Seeking the Court to enlarge the petitioners who are arrayed as accused Nos.2, 3, 7 and 9 in Crime No.909 of 2025 of Jawaharnagar Police Station, Rachakonda Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 09.08.2025, the de-facto complainant lodged a report before the Police stating that, on 08-08-2025 at about 21:00 hours, while the de-facto complainant was at Ambedkar Statue, Yapral along with his friends, one person by name Avinash had parked his bike blocking the road, when the de-facto complainant asked Avinash to remove it, Avinash quarreled with the de-facto complainant and brought his associates, Ajith and Mohan @ Mona. The local residents intervened, compromised the matter, and dispersed them. On 09.08.2025 at about 09:00 hours, while the de-facto complainant was having tea with his friends, accused Persons came armed with sticks and attacked the de-facto complainant and others. In the said attack, the de-facto complainant sustained injuries to his
head, hands and face, his friend Antony became unconscious due to severe injuries, Raman @ Cary suffered a head injury and Mukesh received minor injuries. The injured were shifted to Srikara Hospital, Laxminagar. Basing on the said complaint, the police registered a case in Crime No.909 of 2025 for the above said offence.

Heard Sri T. V. Ramana Rao, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offence and they are in jail from 12.08.2025. It is further submitted that the material part of the investigation was already completed and the injuries are simple injuries. It is further submitted that there are disputes between accused No.3 and the de-facto complainant and other injured victims. It is further submitted that, previously, the wife of accused No.3 lodged a complaint before the police against the de-facto complainant and other injured victims. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. It is further submitted that the Injuries Certificate is not received by the prosecution. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein were arrested on 12.08.2025. Further, as seen from the record, LWs 1 to 14 witnesses were examined. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioners, subject to the following conditions: i.
The petitioners/accused Nos.2, 3, 7 and 9 shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned X Additional Metropolitan Magistrate, Medchal.
ii.
The petitioners/accused Nos.2, 3, 7 and shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners/accused Nos.2, 3, 7 and 9 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
