HON'BLE SRI JUSTICE S.V. BHATT W.P. No.45171 OF 2016 ORDER:

The petitioners pray for the following relief: "...Writ of Mandamus declaring the action of Respondent No 2 herein in not disposing the Writ Petitioners' Appeal vide Rc. No. G/2692/2015 in respect of the lands in Sy. No.24 measuring Ac 12-00 guntas, Sy. No. 171 measuring Ac 15-26 guntas, Sy. No. 172 measuring Ac. 18-31 guntas, Sy. No. 90 measuring Ac 6-20 guntas, Sy.No 240 measuring Ac.7-34 guntas, 241 measuring Ac.7-12 guntas, Sy.No 287 measuring Ac. 9.34 guntas situated at Village Kothapally of Jaipur Mandal, Adilabad District, in pursuance of the mutation granted by Respondent No. 3 in favour of the Unofficial Respondent Nos 4 to 11 herein as arbitrary and consequently direct Respondent No. 2 to dispose of the Writ Petitioners' Appeal vide Rc. No. G/2692/2015 in respect of aforesaid land within three (3) months in the interest of justice..." Heard Mr.Haque for petitioners and the Assistant Government Pleader for Revenue.

The Assistant Government Pleader by referring to the written instructions, states that the appeal is still pending, and the reasons for pendency of appeal are not stated. Since the prayer is inaction, instead of keeping the writ petition pending, this Court considers it appropriate to dispose of the writ petition by directing the 2nd respondent to pass final orders in the appeal in accordance with law after examining the merits, as expeditiously as possible, preferably within two months from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No order as to costs.
