HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18582 OF 2017 O R D E R :

The case of the petitioner is that he made representation dated 28.03.2017 to the 3rd respondent for taking action against the illegal construction made by the 5th respondent in North West Corner of the burial ground situated in Survey No.288, 288/1, 287, Kakatiyanagar, Malkajgiri Mandal, Ranga Reddy District. As no action is being taken, present writ petition is filed.

Learned counsel for the petitioner submits that the petitioner made an application under Right to Information Act, 2005 to know whether the 5th respondent obtained any permission before undertaking construction and the same was replied by the 4th respondent by letter dated 17.04.2017 stating that they have not sanctioned any building permission to the 5th respondent.

Sri Chatla Madhu, leraned Standing Counsel appearing for respondents 2 to 4 on instructions submits that already notice has been issued to the 5th respondent and that necessary action will be initiated.

In view of the aforesaid facts and circumstances, since it is stated that already notice has been issued to the 5th respondent, the 3rd respondent is directed to take action against the 5th respondent, in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.
