THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 14002 of 2011 ORDER:
Sri K.R. Sasidharan Nair, learned counsel, states that Sri Y. Radhakrishna Murthy, learned counsel on record for the petitioner expired. However, in the light of the counter affidavit filed by the police authorities this Court sees no reason to keep the Writ Petition pending. The grievance of the petitioner in this case was that the police authorities had not taken any action on her complaints dated 30.12.2010 and 03.02.2011. These complaints seem to have been made in connection with the death of the
petitioner's sister.
While so, the Sub Divisional Police Officer, Bellampalli Division, Adilabad District, filed a counter affidavit stating that a detailed enquiry was conducted by the police on the complaints made by the petitioner and it was found that the petitioner's sister had died due to cardio respiratory failure and that the death was a natural one. The enquiry report was also stated to have been communicated to the petitioner on 29.05.2011. In the light of the unrebutted averments made in the counter affidavit, it is clear that the allegation of the petitioner that there was inaction on the part of the police authorities upon her complaints is shown to be without basis. In the event the petitioner is aggrieved by the report submitted by the police authorities, it is for her to take appropriate steps in accordance with law. Reserving liberty to the petitioner to do so, the Writ Petition is dismissed. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
