HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6738 of 2017 ORDER:

This Criminal petition is filed by the petitioner/ A2 seeking to quash the proceedings in Crime No.60 of 2017 of Pegadapalli Police Station, Jagtial District, registered on the panchanama proceedings conducted by the 2nd respondent-Sub-Inspector of Pegadapalli Police Station, for the offence punishable under Sections 379 I.P.C.

Heard learned counsel for the petitioner/ A2 and learned Public Prosecutor representing the State and perused the F.I.R. and also the grounds urged in the quash petition and perused the report covered by the pancahanama and F.I.R.

A perusal of the Panchanama with F.I.R. no way requires interference by this Court much less to interdict the investigation. Having regard to the above, the Criminal Petition is disposed of directing the police, in any event, the arrest of the petitioner is required, the police shall strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar 1, as none of the offences punishable supra, are below seven years.
