THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE N.BALAYOGI Civil Revision Petition No.4257 of 2018 ORDER: {Per Hon'ble Sri Justice Ramesh Ranganathan } After arguing for some time, Sri A.Krishnam Raju, learned counsel for the petitioner, seeks permission to withdraw the Civil Revision Petition with liberty to file a fresh application in E.P.No.5 of 2013 on the file of the II Additional District Judge, Visakhapatnam. Without expressing any opinion on whether or not such an application is maintainable, the Civil Revision Petition is dismissed as withdrawn permitting the petitioner, if they so choose, to file an application afresh before the Court below. It is made clear that, in case any such application is filed, the Court below shall also consider whether the said application is maintainable.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
