HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17239 OF 2007 ORDER:

Heard learned counsel for the petitioner and learned counsel for the respondents.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondent institute in not considering the petitioner lowest tenderor and considering the third respondent - 4th lowest tenderor for award of the labour contract in terms of the short tender notification No.Misc./2006/HRD/H1/07, dated 02.08.2007 as illegal and arbitrary. At the time when the matter is taken up for hearing, Sri G.Anandam and Sri Ravi Shankar Jandhyala, learned counsels for respondents submitted that nothing survives for adjudication in the writ petition since the challenge is with regard to notification which was issued in the year 2007 for supply of man power for a period of two years and the said period has lapsed by now. It is further stated that there is no stay granted by this Court. The counsel for the petitioner did not dispute the same.

Recording the statements made and as nothing survives for adjudication in the writ petition, the writ petition is closed. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this writ petition shall also stand closed.
