THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16647 OF 2017 ORDER:

The writ petition, under Article 226 of the Constitution of India, is filed seeking a writ of Mandamus to issue a direction to the respondents 2 and 3 to consider and dispose of the petitioner's representation, dated 28.03.2017, forthwith by taking suitable action for violation for sanctioned plan vide file No.72663/ 06/ 04/ 2016/ C-18, permit No.49728, dated 25.04.2016, and its conditions in respect of property bearing No.72-23, 7-2-1012 and 7-2-1013 situated at Station road, Monda Market, Secunderabad.

Heard and perused the material available on record. The case of the petitioner is that he is the shareholder of the abovementioned property which is his ancestral property and that the respondents 4 to 7 styling themselves as exclusive owners of the said property obtained permission vide permit, dated 25.04.2016 and started construction illegally. The grievance of the petitioner is that though he made a complaint to the respondents 2 and 3 on 28.03.2017 requesting to stop the illegal construction activity being carried on by the unofficial respondents, no action has been taken so far. Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on the merits, this Court is inclined to pass the following order:

" The respondents are directed to consider the representation, dated 28.03.2017, submitted by the petitioner and take appropriate action in accordance with law regarding the unauthorized construction alleged to a have been made by the respondents 4 to 7."

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
