THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45969 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondent Nos.1 to 4 in not considering the petitioner for the post of 'Shramic' in regular basis under the SC backlog vacancies notification 2016, as illegal and arbitrary and for a consequential direction to the 3rd respondent to appoint the petitioner as a 'Shramic'.

The case of the petitioner is that he was working as 'Shramic' in the 3rd respondent office since 2010 on outsourcing basis and having qualifications of 10th class and ITI and also possess National Apprenticeship Certificate and Apprenticeship Certificate from the respondent Corporation. While so, when the 3rd respondent issued notification for the post of 'shramic' under SC backlog vacancies 2016 in the month of June, the petitioner also applied for the said post enclosing with required qualification certificates. As per the said notification the petitioner is absolutely eligible for the said post, but, the respondent authorities did not send any call letter to the petitioner even though he is fully eligible and merit candidate with marks of 589 in ITI. The grievance of the petitioner is that the 3rd respondent is going to select the 5th respondent for the said post who obtained less marks than the petitioner in ITI. The

petitioner also approached the 3rd respondent to consider his candidature for the said post and submitted his representation dated 14.12.2016. But, till today no orders are passed on the same. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner.

Sri S.V.Ramana, learned counsel appearing for the respondent Corporation submits that the respondent authorities will consider the case of the petitioner as per merit and Rules in force regarding appointment of 'Shramic'.

In view of the above facts and circumstances, the competent authority is directed to consider the candidature of the petitioner who have applied in pursuance of the notification in terms of merit as well as Rules in force and take action accordingly.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 28.12.2016 t k.
