HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.1300 of 2016 ORDER :
This writ petition is filed by the petitioner seeking Mandamus declaring the action of respondent Nos.3 and 4 in interfering with the civil disputes in respect of the land in Sy.No.277 admeasuring to an extent of 2335.55 square yards, situated at Mancherial Village and Mandal, Adilabad District, at the instance of unofficial respondents, despite pendency of O.S.No.64 of 2015 on the file of Principal Senior Civil Judge, Mancherial, Adilabad District, as illegal and arbitrary, and consequently, sought a direction to respondent Nos.3 and 4 not to interfere in the civil disputes in respect of the said land.
Learned counsel for the petitioner submits that subsequent to the filing of the present writ petition, the respondents - police stopped interfering with the disputes in respect of the subject property. He further submits that the petitioner may be given liberty to initiate appropriate action in the event of interference by the respondent - police in respect of the subject property in future.
Learned Assistant Government Pleader for Home submits that respondent No.4 has filed counter affidavit stating that they have not interfered with the affairs of the
GSP,J W.P.No.1300 of 2016 petitioner in respect of the subject property involved in the above suit, except conducting investigation in Crime No.3/2016 of Mancherial Police Station, Adilabad District, registered for the offences punishable under Sections 341, 506 r/w. Section 34 IPC, wherein the petitioner was shown as A.1 in the FIR.
In view of the said submissions, this writ petition is disposed of giving liberty to the petitioner to avail appropriate remedies available under law as and when there is any interference by the respondent - police in respect of the subject property. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
