Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.
This Writ Petition is filed seeking to declare the action of the 2nd respondent in suspending the authorization of the petitioner vide proceedings dated 13.03.2015, as arbitrary and illegal. Petitioner is the dealer of fair price shop No.20, B.Cherlopalli Village, Simhadripuram Mandal, Kadapa District. Based on the report submitted by the Deputy Tahsildar alleging certain irregularities and variations in the stock at the time of inspection, the 2nd respondent issued show cause notice to the petitioner for which, she submitted her explanation. Without considering the same, the 2nd respondent suspended the authorization of the petitioner. Since the impugned order was passed pending enquiry, the Writ Petition is disposed of directing the 2nd respondent-Revenue Divisional Officer to conduct enquiry and pass final order within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
