THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.32805 of 2015 ORDER:

The prayer of the petitioner was to declare the action of the police authorities of Jagtial, Karimnagar District, in harassing him to deliver the original Registration Book and NOC issued by the Motor Vehicles Registering Autority, Kurnool, to the sixth respondent and keeping the auto bearing registration No.AP21Y 4994 in I Town Police Station, Jagtial, as arbitrary and illegal. The Inspector of Police, Jagtial Town Police Station, Karimnagar District, filed a counter-affidavit denying the allegations made by the petitioner. According to him, the police authorities never harassed the petitioner to deliver the original documents relating to the subject auto to the sixth respondent. He further denied the allegation of the petitioner that the said auto was kept in the police station.

All other allegations made by the petitioner were categorically denied. The Inspector further stated that no complaints had been received and no criminal case was registered against the petitioner or the sixth respondent on the file of Jagtial Town Police Station. No reply-affidavit was filed by the petitioner rebutting the afore-stated counter-averments. In the light thereof, this writ petition does not merit adjudication on merits and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
