Mohd. Tajamul Hussain, v. Zaneera Sultana,
THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.1685 of 2014
ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 to A5 seeking to quash the proceedings in C.C.No.187 of 2013 on the file of II Additional Judicial First Class Magistrate at Kothagudem, for the offences punishable under Section 498-A IPC and u/s.3 and 4 of Dowry Prohibition Act, against them.
2. A1 is the husband of the de facto complainant. It is alleged in the charge sheet that A1 with the support of his family members i.e., petitioners/A2 to A5 used to harass the de facto complainant by demanding additional dowry and threaten her with dire consequences.
3. In view of the allegations mentioned in the charge sheet and also the nature of proceedings, this Court is not inclined to interfere with the impugned proceedings. Since the offence alleged against the accused is under Section 498-A IPC, the question of identity does not arise, as such, the presence of the petitioners/A2 to A5 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel on all hearing dates.
4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
