This petition under Section 438 of the Criminal Procedure Code is filed by petitioners/Accused Nos.1 and 2 in crime No.10 of 2017 of Gangavaram Police Station, East Godavari District, registered for the offences punishable under Sections 323, 324, 509 and 506 read with 34 of Indian Penal Code and Section 3 (1) (r) (s) of SCs & STs (POA) Act, 2015, to direct the SHO of said Police Station to release the petitioners on bail in the event of their arrest in connection with above crime. After arguing for a while, Sri Mangena Sree Rama Rao, learned counsel for the petitioners, requested this Court to permit the petitioners to surrender before concerned Court, on such surrender, if any application is filed by the petitioner for grant of bail, the Presiding Officer may be directed to decide the application on the same day.

Acceding to the request of the learned counsel for the petitioners, without adverting to merits of the case, petitioners are permitted to surrender before the Special Court for Trial of Offences under SCs & STs (POA) Act. On such surrender, if any application is filed by the petitioners u/s.439 Cr.P.C. after serving notice on the PP, the Presiding Officer of the said Court is directed to decide the application on the same day, in accordance with law.
