HON'BLE SRI JUSTICE S. RAVI KUMAR CONTEMPT CASE No.169 of 2015 ORDER:

This contempt case is filed under Contempt of Court Act, 1971 (for short, 'the Act') to punish respondents under Sections 10 and 12 of the Act on the ground that they violated the order of this Court, dated 28.11.2004, in C.R.P.M.P.No.6011 of 2014 in C.R.P.No.3920 of 2014.

2. Heard both sides.

3. Advocate for petitioners submitted that the main C.R.P. is disposed of still as the interim order dated 28.11.2004 is not complied respondents have to be punished for contempt.

4. Advocate for respondents submitted that the main C.R.P. is disposed of directing the Court below to decide I.A.No.2096 of 2014 within fixed time without being influenced by the impugned order dated 09.10.2014. He further submitted a contempt case filed in the very same C.R.P. is also disposed of along with the main C.R.P. as nothing survives and submitted that in this case also nothing survives because of the disposal of the main C.R.P.

5. I have perused the material papers.

6. It is the contention of petitioners, the action of respondents in not including the names of petitioners in the Managing Committee amounts to contempt. C.R.P.No.3920 of 2014 is preferred against the order, dated 09.10.2014, in I.A.No.2096 of 2014 in O.S.No.830 of 2014, challenging the suspension of the members from the Indian Medical Association and now that I.A. has to be decided on merits as per directions of this Court and then only the claim of petitioners for inclusion can be considered. As rightly pointed out by advocate for respondents, in view of the final disposal of C.R.P.No.3920 of 2014 nothing survives in the contempt case.

7. Accordingly, contempt case is dismissed.
