THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26724 OF 2016 ORDER:

Heard.

2. The case of the petitioners is that they are the lawful owners and possessors of the lands admeasuring Ac.1-10 guntas under Survey No.94, Ac.1-17 guntas under Survey No.96, Ac.1-10 guntas under Survey No.97 and Ac.1-10 guntas under Survey No.104 situated at Khajaguda Village, Serilingamapally Mandal, Ranga Reddy District, having acquired the same by way of succession. Since then petitioners are in actual and peaceful possession and enjoyment of the subject lands without there being any interruption. While so, as the neighbouring land owners are trying to encroach into the subject lands, petitioners through GPA made an application dated 21.11.2015 to the second respondent by paying requisite fee through mee-seva challan, for conducting survey and demarcation and for fixation of boundary stones surrounding the subject lands. As the second respondent has not taken any steps either for conducting survey or for considering the application of the petitioners, the present writ petition is filed.

3. Learned counsel on either side fairly submits that this writ petition is similar to the one considered by this Court in W.P.No.26097 of 2016, which was disposed of by this court by order dated 04.08.2016.

4. Following the same, this Writ Petition is also disposed of and

the second respondent is directed to cause survey for demarcating the lands of the petitioners by considering the application dated 21.11.2015 submitted by the petitioners after collecting necessary charges therefor within eight weeks from the date of receipt of a copy of this order after issuing notice to the petitioners and other affected parties and communicate his decision thereon to the petitioners.
