THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN WRIT APPEAL No.920 OF 2017 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have considered the impugned order passed by the learned single Judge.

The matter relates to the realm of procuring 'Balamrutham', which is a value added product to be given to infants through the Integrated Child Development Services (ICDS) Programme. The learned single Judge has found that there is no violation of certification norms, and though the tenderers were required to provide their certification under the Prevention of Food Adulteration Act, the fact of the matter remains that they were also required to provide certification under the Food Safely Laws and therefore, there is no violation of any law. The learned single Judge has further found that there is no statutory prescription as to the quality of the product required to be supplied and the challenge levied to the tender after the last date fixed for the acceptance of the tender is not worth consideration. We do not find any illegality, infirmity or jurisdictional error in the order passed by the learned single Judge. The writ appeal fails and is accordingly dismissed.

The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
