THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.613 of 2015 ORDER:

Upon hearing the learned counsel for the petitioner, at the admission stage, the following order is passed: As per the submission of the learned counsel for the petitioner, the cheque subjected to C.C.No.164 of 2014 was issued to one Mr. V. Devender Reddy towards collateral security along with the Mortgage Deed and the said cheque was not issued in due discharge of any legally enforceable debt and the said Devender Reddy who is a common friend of the petitioner and the first respondent, colluded with the first respondent in order to snatch away the valuable immovable property worth of Rs.20,00,000/- got registered the case against the petitioner/accused.

Having regard to the above nature of the defense, in the considered view of this Court, the said aspect has to be decided only after full-fledged trial, but not in this quash petition. Therefore, this Criminal Petition is dismissed with a direction to the petitioner/accused to appear before the trial Court and face the trial. As a sequel, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
