HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.8996 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Public Prosecutor for the 1st respondent and perused the record.

This Criminal Petition is filed seeking to quash the proceedings in S.C.No.68 of 2016 on the file of the VI Additional District & Sessions Judge, Godavarikhani, Peddapalli (Karimnagar) District. There is record to show that the committal Court has taken cognizance against the petitioner for the offences under Sections 323, 506 IPC and Section 3(1) (r) (s) and 3 (va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 and committed the case to the Court of Sessions referred above and the case is pending before the said Court.

It is brought to the notice of this Court that no charges are framed in the Sessions Case.

Under these circumstances, the petitioner is entitled to put up his defence before the Court of Sessions to seek discharge. With these observations, the Criminal Petition is dismissed.
