THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36911 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent Nos.3 and 4 in opening suspect/rowdy sheet against the petitioner in the year 2012 and continuing the same without closing for the last four years as illegal, arbitrary and violation of the Police Standing Orders and consequently, to direct respondent Nos.3 and 4 not to insist the petitioner to attend the police station for his signature in relation to the alleged suspect/rowdy sheet opened against him in the year 2012.

Case of the petitioner is that respondent Nos.3 and 4 opened suspect/rowdy sheet against him in the year 2012 and are continuing the same without closing it for the last four years and they are insisting him to attend the police station for his signature every fortnight and making him to sit till evening. Crime No.601 of 2012 on the file of Azith Singh Nagar Police Station, Vijayawada, Krishna District was registered against him under Sections 509 and 506 I.P.C. basing on a complaint given by one Usha Kishan and the said case was closed before Lok Adalat on 17.11.2012 and thereafter, the petitioner has not committed any crime and hence, he prays to give a direction to respondent Nos.3 and 4 to remove his name from the suspect/rowdy sheet.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, the petitioner is directed to make an

application to the Deputy Superintendent of Police, Vijayawada, Krishna District for removal of his name from the suspect/rowdy sheet by placing all the material and the relevant documents and on such application, the Deputy Superintendent of Police, Vijayawada shall dispose of the same in accordance with law on or before 10.12.2016.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
