O R D E R
Alleging that 4th respondent - Station House Office, Police Station, Banjarahills, Hyderabad, is interfering with the civil dispute of the petitioner, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Inspector of Police, Police Station, Banjara Hills, Hyderabad, dated 26.07.2018, denying the allegation of the petitioner. In the written instructions, it is stated that one Syed Ali Abid Zaidi, son of SBH Zaidi, lodged a complaint, based on which case in Cr.No.
1050 of 2017 was registered against the petitioner on the file of Banjara Hills Police Station, Hyderabad, for the offences punishable under Sections 341, 448, 420, 506 IPC and petitioner obtained anticipatory bail and the crime is pending investigation and after completion of the same, appropriate report will be filed under Section 173 of Cr.P.C. before the court. It is stated that petitioner was involved in six other cases in various police stations and a rowdy sheet was opened against him on the file of Banjara Hills Police Station, Hyderabad on 6.6.2018. It is stated that petitioner is involved in a case of attempt to murder in F.IR.No.8/ 2018 under Sections 307, 120(B) read with 34 IPC and Section 27 of Arms Act of Police Station, Humayun Nagar Police Station on 29.05.
2018 and remanded to judicial custody and was released on bail on 16.06.2018. It is stated that 4th respondent never interfered with the civil dispute of the petitioner, as alleged in the writ petition.
Recording the above statement made in the written instructions, writ petition is disposed of.
It is need less to observe that it is always open to the respondents to investigate into the crimes stated to have been registered against the petitioner. However, life and liberty of the petitioner, shall not be interfered with, except by following due process of law. Miscellaneous petitions pending, if any, shall stand closed.
