CVNR, J & MSKJ, J CMA.No.87 of 2007 Dt:03.11.2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal is filed against the order and decree, dated 20.11.2006, in O.P.No.57 of 2003 on the file of the learned Senior Civil Judge, Kavali, whereby he has dismissed the said O.P. filed by the appellant for dissolution of marriage between him and the respondent.

This case was adjourned on three occasions at the request of the learned counsel for both parties. On 27.10.2016, when the case was last adjourned, the learned counsel for the appellant has requested for a week's more time for placing before the Court his client's willingness or otherwise for payment of reasonable amount to the respondent in the event of grant of divorce.

Today, at the hearing, learned counsel for the appellant submitted that his counter-part in the lower Court has addressed a letter to him stating that he is unable to contact the appellant. Learned counsel has, accordingly, submitted that he has no instructions for arguing the case.

In the light of the above facts, the appeal is dismissed for non-prosecution.
