HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.310 of 2015 ORDER:

This criminal petition is filed under Section 439 (1) of Cr.P.C., seeking relaxation of the condition imposed in the order dated 01.09.2014, passed in Crl.M.P.No.217 of 2014 by the Special Judge for SPE and ACB Cases-cum-II Additional District & Sessions Judge, Nellore.

The learned Special Judge for SPE and ACB Cases-cum-II Additional District & Sessions Judge, Nellore vide order dated 01.09.2014 passed in Crl.M.P.No.217 of 2014, while releasing the petitioner on bail imposed a condition directed the petitioner to appear before the respondent therein i.e., D.S.P., ACB, Nellore, every day between 02.00 PM and 05.00 PM and also to sign in the register kept by the respondent until further orders. Subsequently, on 05.11.2014, the learned Special Judge modified the condition and directed the petitioner to appear before the authorities twice in a week i.e., every Monday and Thursday between 02.00 PM and 05.00 PM. Thereafter, in the month of December 2014, the petitioner filed an application for relaxation of the condition, which was rejected.

A perusal of the record disclose that the petitioner herein who is a government servant was working as Royalty Inspector, O/o. Assistant Director, Mines and Geology, Nellore at the time of incident. He was charged with the offences punishable under Sections 7 and 13 (1)(d) of Prevention of Corruption Act. Having regard to the same and taking into consideration the fact that the petitioner was in jail for more than 60 days, the request of the petitioner can be considered. Accordingly, the condition of reporting before the respondent twice in a week is hereby relaxed by retaining all other conditions.
