HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34346 of 2016 ORDER:

The petitioners pray for the following relief: "This Hon'ble Court may be pleased to issue appropriate writ, order or direction particularly a writ of mandamus declaring the action of respondents in seeking to demolish the constructions of the petitioners in respect of No15-2-55/1 and 15-2-55/2, situated at opposite Krishna Talkies, SVP Road, Mulugu road, Hanamkonda, Warangal District constructed in land admeasuring Acs.2.34 guntas in Survey No.757 without giving notice and opportunity of hearing to the petitioners as illegal, arbitrary, without jurisdiction and violative of Articles 14, 21 and 300-A of Constitution of India."

Ms.P.Lakshmi, learned Standing Counsel appearing for respondent No.2, on oral instructions, makes a statement that the writ petition is based on apprehension, for, the subordinates of respondent No.2 have inspected the premises and no endeavour was made to demolish or dispossess the petitioners and in the alternative, if respondent No.2 intends to proceed either for dispossession or demolition of structure at the subject premises, the same will be in accordance with law. The statement is placed on record.

Writ petition is accordingly disposed of.
