THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37866 of 2014

O R D E R

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declaring the action on the part of the respondents herein harassing the petitioner by calling police station as an active social worker and politician influenced by the rival group in the area politics basing on the F.I.R. No. 96/2014 dt. 18.4.2014 u/s 110(e) of Cr.P.C. registered pursuant to the elections 2014 even though six months is over is highly illegal arbitrary and violative of article 14,16 and 21 of the constitution of India and quash the same and consequentially direct the respondents not to harass the petitioner by calling the police station and to pass such other order or orders as this Honble Court may deems fit just and proper in the circumstances of the case."

The Assistant Sub Inspector of Police, Koyyalagudem Police Station, West Godavari District, furnished written instructions dated 24.02.2016 to the office of the learned Government Pleader for Home, wherein he stated that Crime No.96 of 2014 was registered under Section 110(e) Cr.P.C. and basing thereupon, proceedings vide M.C.No.32 of 2014 were initiated before the Mandal Executive Magistrate. However, upon enquiry, it was found that the ingredients necessary for establishing that the petitioner was not keeping peace and maintaining good behaviour were not made out and accordingly, the proceedings were closed on 17.12.2015.

In the light of the afore-stated developments, the cause in this writ petition no longer survives for consideration on merits. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
