HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.24442 of 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondent Nos.1 and 2.

The prayer sought in the writ petition is as under: "... to issue order or orders more particularly one in the nature of writ of Mandamus declaring the inaction of the respondents herein in not register a crime as per the complaint dated 20.06.2012 and proceeding an enquiry as illegal, arbitrary against the law and violation of Article 21 of the Constitution of India and it is also prayed that this Hon'ble Court may be pleased to direct the respondent No.2 herein to initiate departmental and criminal action against the respondent No.3 herein for the violation of direction of law, dereliction of duties and misuse of public office and submit the report for necessary action." Learned Government Pleader placed on record written instructions dated 13.11.2019 issued by the Assistant SubInspector of Police, Talakondapally Police Station, Cyberabad Commissionerate.

From a perusal of the said written instructions, it is revealed that on the complaint lodged by the petitioner an entry in General Diary was made on 20.06.2012. On the preliminary enquiries made by the 1st respondent it was revealed that as per the revenue records, the petitioner's brother Jeelala Yadaiah was the pattedar and possessor of the land admeasuring Ac.4.04 guntas in Sy.No.70/A situated at outskirt of Chennaram village. The matter is civil in nature.

The police have suggested the petitioner/complainant to approach the competent civil Court for redressal.

In that view of the matter, no further cause would survive in the writ petition. However, if the petitioner has got any objections

or grievance against the investigating officer, liberty is given to him to file a protest application as per law.

With the above said observations, the writ petition is disposed of. No order as to costs.
