HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26004 OF 2018 O R D E R :

This writ petition is filed challenging the action of the 2nd respondent in calling the petitioners 1 to 3 to the police station and insisting them to enter into compromise with the 3rd respondent, without there being any complaint made against the petitioners.

Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint made by the 3rd respondent on 27.06.2018, a case in Crime No.406/2018 was registered against the petitioners under Sections 406, 420, 464 and 477 r/w 34 IPC; that only for the purpose of enquiry in the said case, petitioners were called to the police station. It is also stated that during the course of investigation, the Investigating Officer called the petitioners to submit any documents pertaining to the said case on their behalf, but the petitioners instead of producing the documents before the Investigating Officer, approached this Court by filing this writ petition.

Learned counsel for the petitioners submits that the respondents called the petitioners to the police station in the month of June, 2018 itself, but, in the written instructions it is

stated that the complaint against the petitioners was lodged on 27.06.2018.

In view of the facts and circumstances, recording the submission of learned Assistant Government Pleader, the writ petition is disposed of. However, it is open for the petitioners to challenge the registration of crime, in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
