Heard learned counsel for the petitioners, learned Government Pleader for Irrigation for respondent Nos.1 to 5, and learned Standing Counsel for respondent No.7. This writ petition is filed challenging the action of respondent Nos.4 to 6 in trying to construct a water tank in the petitioner's land admeasuring 813.33 square yards in Survey No.462, situated at Pillalamarri Revenue Village, Gram Panchayat Board, Gandhinagar, Suryapet Mandal and District. Even before issuance of notice before admission, a counter-affidavit is filed by respondent No.5 admitting the possession of the land of an extent of Ac.0.16 guntas in Survey No.462 by the petitioner. It is stated that when respondent Nos.4 and 5 went to dig pit on 14.06.2017 in the Government land in Survey No.441, the petitioner raised an objection.
Thereafter, a survey was conducted and it came to light that the land in Survey No.441 is a Government land and the land of the petitioner in Survey No.462 is far away from the said Government land. The objection of the petitioner was based on lack of understanding.
Ac.0.011⁄2 gunta of land in Survey No.441, which is now recognised as Government land.
In view of the above, the apprehension of the petitioner has no basis. The writ petition is accordingly closed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO,J Dt:02.08.2017 kdl
