This writ petition is filed challenging the action of the 3rd respondent in interfering with the peaceful possession of the petitioner over the subject land.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioner a case in Crime No.81/2018 was registered against the 4th respondent; that basing on the complaint of the 4th respondent a case in Crime No.79/2018 was registered against the petitioner and others; that basing on the complaint lodged by the son of 4th respondent a case in Crime No.102/2018 was filed against the petitioner; and that except registration of above crimes and proceeding with the investigation into the said cases, the respondent police never interfered with the possession of the petitioner over the subject lands; and that as part of investigation only the 3rd respondent has visited the subject land in question. Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of directing the respondent police not to interfere with the civil disputes pending between the petitioner and 4th respondent.
However, this order will not preclude the respondent police from investigating into the offences filed against the petitioner and also against the 4th respondent. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 26.07.2018 t k.
