HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13098 OF 2017 ORDER:

The case of the petitioner is that he filed a claim petition for grant of patta under Section 11(a) of the Estates Abolition Act before the 2nd respondent vide Reference No.E2/3392 of 1984, B9/3383 of 1984 in respect of the land in Sy.No.134/6 of Chowdepally Village and Mandal, Chittoor District and the same is pending. Against the same, petitioner filed W.P.No.7447 of 2008 and this Court vide order dated 15.04.2008 directed the 2nd respondent to complete the enquiry. Accordingly, the 2nd respondent took up enquiry and issued notices directing the petitioner to produce all documentary evidence in support of his claim petition. On 01.03.2014, the 2nd respondent informed the petitioner that he will be issued notice for the next date of hearing. Since petitioner has not received any notice, finally on 30.01.2016, he filed a memo requesting the 2nd respondent to conduct further enquiry and dispose of the matter. But so far no action has been initiated. Aggrieved by the same, the present writ petition is filed.

Heard both sides.

In view of the above facts and circumstances, the 2nd respondent is directed to complete the enquiry pending in Reference No.E2/3392 of 1984, B9/3383 of 1984 and take action accordingly within period of four (04) months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.
