THE HON'BLE SMT. JUSTICE T. MADHAVI DEVI CONTEMPT CASE No.2365 of 2023 ORDER:
Learned Stalding Counsel for the Singareni Collieries Company Limited has produced a copy of speaking order, dated 25.11.2023 passed by the General Manager, personnel Department, Bhupalapalli Area, Singareni Collieries Company Limited, whereby the application of the petitioners for compassionate appointment has been considered and rejected on the ground that the second petitioner (married daughter) is not solely dependent on t.lle deceased employee. Therefore, according to the learned Standing I Counsel, the direction of this Court dated O4.O8.2O23 in W.p. ,t No.1977O of 2023 has duly been complied with. Learned counsel for the petitioners, however, submitted that the orders of this Court have not been complied with in their true spirit.
After going through the orders, dated 04.08 .2023, this Court is satisfied that the respondents have not rejected the case of the petitioners because second petitioner is a married daughter of the
deceased employee, but on considering merits of the case holding that she is not dependent on the deceased employee. Therefore, there is no violation of orders of this Court on the part of the respondents.
Accordingly, the Contempt Case is closed with liberty to the petitioners to challenge the speaking orders of the respondents :
dated 25,11.2023. No costs.
