Yerneni Srinivas v. The State Of Telangana,
THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.36220 of 2014 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader appearing for respondent Nos.1 to 4. 2.
The prayer sought in the writ petition is as under:- "...to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 4 in not recovering surgical products, in not recording statements of witnesses and in not investigating the case in Cr.No.168 of 2014 of Karkhana Police Station is highly arbitrary, bad and illegal and consequently direct the 2nd respondent either to appoint some other officer to investigate the case or to hand over the investigation to CBCID and pass such other order or orders as deem fit and proper." 3.
Learned Government Pleader brought to the notice of this Court that pursuant to registration of Crime No.168 of 2014 of Karkhana Police Station, investigation was completed and a charge sheet was filed. Subsequently, after taking cognizance of the offence, the matter was taken on file as C.C.No.782 of 2014 on the file of the learned XIX Additional Chief Metropolitan Magistrate, Hyderabad. On trial, the matter ended in acquittal on 29.06.2018.
4.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
5.
Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________________ P. KESHAVA RAO, J 9th January 2020 mar
