Order :

Feeling aggrieved by the inaction of respondent No.3 in appointing the petitioners as fair price shop dealers, the petitioners filed this Writ Petition.

At the hearing, the learned Government Pleader for Civil Supplies (TS) submitted that pending this Writ Petition, petitioner Nos.1 and 3 were appointed as the permanent dealers in December, 2014, and that as petitioner No.2 was found ineligible for such appointment, she was not appointed. He has further submitted that no order in writing rejecting the application of petitioner No.2 was passed and communicated to him.

Inasmuch as a right is created for compassionate appointment by G.O.Ms.No.4, dated 28-02-2014, it is incumbent upon respondent No.3 to pass an order in writing and communicate the same to petitioner No.2 in order to enable the latter to avail further remedies, if he feels aggrieved thereby.

In this view of the matter, the Writ Petition is disposed of as infructuous qua petitioner Nos.1 and 3. As regards petitioner No.2, respondent No.3 is directed to pass a reasoned order and communicate the same to the said petitioner within one month from the date of receipt of this order. Petitioner No.2 is left with liberty to avail further remedies, if he feels aggrieved by the order that may be passed by respondent No.3. As a sequel to disposal of the Writ Petition, WPMP.No.46900 of 2012, filed by the petitioners for interim relief, is disposed of as infructuous.
