THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38196 of 2016 ORDER:
This writ petition is filed seeking to declare the impugned action of respondents 2 & 3 in not acting upon the complaint of the petitioner, dated 08.12.2015, and on the subsequent representations, dated 30.04.2016 and 03.10.2016, and thereby infringed the fundamental rights of the petitioner, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that the petitioner is the permanent resident of H.No.2-97, Pydiparru of Tanuku, West Godavari District. While the petitioner and her children are enjoying the said property, the 4th respondent came to the petitioner's house and obtained a false agreement of sale on 30.06.
2015 by threatening the petitioner and her family and the 4th respondent, with the help of some rowdy elements, came to the house of the petitioner and high-handedly trespassed into the house on 05.12.2015 and abused her in filthy language and the 4th respondent also created terror in the vicinity. Aggrieved by the same, the petitioner has made a complaint to the 3rd respondent on 08.12.2015. The grievance of the petitioner is that though the complaint was made by the petitioner on 08.12.2015 to the 3rd respondent, the 3rd respondent is not registering the same, having influenced in the hands of the 4th respondent.
Considering the grievance of the petitioner, the 3rd respondent is directed to register a case against the 4th respondent, if the complaint lodged by the petitioner, dated 08.12.2015, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 3rd respondent, she is at
liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 7th November, 2016 KL
