Mohd. Abdul Juned v. Convener
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.25984 of 2018 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not permitting the petitioners and other similarly placed students for counselling for the Polytechnic courses for the academic year 2018-19 as being illegal, arbitrary and unconstitutional and consequently direct the respondents to conduct fresh counselling for the petitioners and other similarly placed students whose SSC advanced supplementary results have been declared after the counselling has closed for Polytechnic courses for the academic year 2018-19.
2.
Heard the learned counsel for the petitioners, the learned Standing Counsel for respondents 1 and 2 and the learned Asst. Government Pleader for Higher education. 3.
Learned standing counsel Sri A. Abishek Reddy, submits that the petitioners appeared for SSC advanced supplementary examinations in the month of June, 2018 and whose results are awaited were also made eligible to apply for Polytechnic admissions counselling and this fact was mentioned in the TS Polycet-2018 admission notification. It is
also stated the petitioners have not applied for Polytechnic counselling though the notification provided for applying for Polytechnic counselling whose SSC advanced supplementary results were yet to be declared. Learned counsel states that now the counselling is over and admissions are closed and the classes have also been started.
4.
It is to be seen that the notification itself provided that candidates who appeared for SSC advanced supplementary examination can also apply for Polytechnic admissions counselling, but the petitioners did not apply, though in the notification such an option was given. In the circumstances, no relief can be granted to the petitioners at this stage. The writ petition fails and it is accordingly dismissed.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
