HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI A.S.Nos.3511 & 3571 of 2003 COMMON JUDGMENT:

When both these Appeals are taken up for hearing, learned counsel for the appellants had contended that he has no instructions from his clients to argue the matters and the 1st appellant and sole respondent in both the appeals had expired eight years back.

Learned counsel for the sole respondent had contended that the sole respondent has expired and he has also furnished the details of legal representatives of the 1st appellant. In spite of the same, the legal representatives of the sole respondent were not brought on record.

Learned counsel for the 1st appellant had contended that both the appeals are to be closed as there are no instructions to argue the appeals.

AKS,J A.S.Nos.3511 & 3571 of 2003 In view of the same, this Court is of the considered view that the present Appeals are liable to be dismissed for nonprosecution. Accordingly, both the appeals are dismissed for nonprosecution. No costs. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
