THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5137 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioners/A-1 to A-10 seeking to quash the proceedings in Crime No.164 of 2016 on the file of Machavaram Police Station, Machavaram, Vijayawada, Krishna District, Andhra Pradesh.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioners are punishable under Sections 405, 409, 418, 420 and 423 I.P.C., Section 13 of the A.P. Protection of Depositors of Financial Establishment Act, 1999 and Section 38 of the A.P. Mutually Aided Cooperative Societies Act, 1995.

4. After arguing for sometime, learned counsel for the petitioners prayed this Court to direct the respondent police to issue notice under Section 41(1)(a) Cr.P.C. to the petitioners if they intend to arrest the petitioners.

5. Considering the facts and circumstances of the case, the respondent police are hereby directed to issue notice under Section 41(1)(a) Cr.P.C. to the petitioners herein if they intend to arrest the petitioners and to proceed in accordance with law.

6. Accordingly, the Criminal Petition is disposed of.

7. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
