HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12397 OF 2012 ORDER:

Heard learned counsel for the petitioners and learned Assistant Government Pleader for land acquisition.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in not allotting house plots to the petitioners under R.R.Scheme at Gundlapalli Colony, Garlapadu, Maddipadu Mandal, Prakasam District, as illegal and arbitrary. A counter came to be filed by the respondents stating that petitioner Nos.1 and 4 were allotted plots bearing Nos.151 and 150 respectively on 25.09.2012 at Gundlapalli Colony, Garlapadu Village, Maddipadu Mandal as per R&R policy guidelines. It is further stated that one more plot was allotted to the second petitioner on 29.10.2015 bearing plot No.149 in the same colony. Learned Assistant Government Pleader for Land Acquisition submits that the third petitioner will be allotted plot, if sufficient time is given.

Recording the statements made in the counter affidavit and also the submission made by the learned Assistant Government Pleader for Land Acquisition, the Writ Petition is disposed of directing the respondents to allot plot in favour of the third petitioner, as expeditiously as possible preferably within a period of four (04) weeks from today. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
