HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1760 of 2015 ORDER:

This revision is preferred challenging the order dated 07-07-2015 passed by the Principal Sessions Judge, Khammam in Crl.M.P. No.511 of 2014 in Cr.No.315 of 2014, wherein and whereby the learned Sessions Judge refused to defreeze the Savings Bank account of the petitioner herein.

The brief facts of the case are as follows :

The petitioner is arrayed as accused No.1 in Crime No.315 of 2014 of Yellandu Police Station, Khammam District, registered for the offences punishable under Section 420 I.P.C. and Section 5 of A.P. Protection of Depositors of Financiers Act, 1999 and Section 4 of Chit Fund Act.

During the course of investigation, the petitioner's Savings Bank Account bearing No.62131667496 was ordered to be freezed, since huge amount is involved in the said case concerned. It is the case of the petitioner that in her Savings Bank account, the amount available is only Rs.4,700/- and further, the family pension for which she entitled is normally credited in the said account. A perusal of the impugned order does not disclose as to what is the actual

amount available in the said account before the concerned branch. The learned counsel for the petitioner submits that the amount available is only Rs.4,700/- and further the said account does not have any huge money as observed by the learned trial Judge.

Heard and perused the records.

Having regard to the facts and circumstances of the case, this Court is of the view that the instant revision can be disposed of as follows :

The petitioner is at liberty to withdraw any further amounts deposited in her Savings Bank Account bearing No.62131667496 by way of family pension and the order of freezing will not stand in the way of the petitioner to withdraw the amount from the said account as far as the family pension is concerned.

The Bank Authorities concerned are also directed to allow the petitioner to withdraw the amounts deposited in the said account by way of family pension.

Accordingly, the Criminal Revision Case is disposed of.

Miscellaneous petitions filed in this revision, if any, shall stand closed.
