HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40568 of 2012 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.1 to 3 in not taking appropriate action on the representations submitted by the petitioner dated 23.07.2012 and 10.09.2012 with regard to entries in the pahanies in respect of land admeasuring Ac.0.58 cents in Sy.No.590/2 and Ac.6.57 cents in Sy.No.595 situated at Rachapalle Revenue Village, Makavaripalem Mandal, Visakhapatnam District, as illegal, arbitrary and violative of principles of natural justice; and consequently direct the respondents to take action on the representations.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to respondent No.3 to consider the representation dated 10.09.2012. Without going into the merits of the case and having regard to the circumstances stated above, the writ petition is disposed of directing the third respondent, to consider the representation which was marked to him and addressed to the Collector, Visakahaptnam and the same was acknowledged by the office of Collector by giving complaint No.36281 dated 10.09.2012, in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order, if the same is still pending. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
