HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23580 of 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India challenging the action of the respondents 2 and 3 in not considering the complaints of the petitioner dated 06.07.2017 and 29.06.2017, against the illegal construction over the land earmarked for park in layout No.49/ 80 at Sy.No.205 & 206, Ward No.23, Balajinagar, Sangareddy Municipality/ Town, Sangareddy District,. The case of the petitioner is as follows:
The petitioner is a resident of Balajinagar, Sangareddy Town. In the layout of the said colony, an open place was earmarked for park and in that place some illegal constructions are going on. Therefore, the petitioner and the other residents of Balajinagar made complaints to the respondents 2 and 3 to take action against the said illegal constructions. But, no action has been taken so far by the respondents on the complaints made by the petitioner and others. Hence, the present writ petition.
Heard and perused the material available on record. The main grievance of the petitioner is that he along with the other residents of Balajinagar have given complaints on 06.07.2017 and 29.06.2017 to the respondents 2 and 3 for taking action against the illegal constructions in the open place earmarked for the park. But, the respondents 2 and 3 have not passed any orders so far.
Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:
" The respondents 2 and 3 are directed to consider the complaints, dated 06.07.2017 and 29.06.2017, of the petitioner and others, and pass appropriate orders, in accordance with law, as expeditiously as possible, preferably, within a period of eight
(8) weeks."
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
