HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1446 of 2005 ORDER:

The present Writ Petition came to be filed seeking the following relief:

" .... declaring that the petitioner is entitled to use the entire extent of Ac.7.74 in Survey No.368/1A of Thimmapur Village, Mahanandi Mandal of Kurnool District in the manner it chooses for the purposes of Sri Vivekananda Gurukula Vidyalayam and any interference by the respondents is totally arbitrary, illegal, irregular, unconstitutional, unjustified and unsustainable and hold that the land from the petitioner cannot be resumed to the Government without following the due procedure prescribed under law ........"

Heard Sri P.Veera Reddy, learned senior counsel, appearing on behalf of the learned counsel for the petitioner, and the learned Assistant Government Pleader for Revenue.

Though various grounds are raised in the writ petition, the learned senior counsel submits that the present writ petition is filed on an apprehension that the authorities would dispossess the petitioner from the subject land without following due process of law, though the petitioner is in possession of the same. Learned AGP for Revenue submits that any action taken by the authorities would be in accordance with the procedure established under law.

Recording the statement of the learned AGP, the Writ Petition is disposed of directing the respondents-authorities to

follow due process of law in case they intend to take any action against the petitioner.
