O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) This writ petition by the tenant assails the proceedings initiated by the India Infoline Housing Finance Limited under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for brevity, 'the SARFAESI Act').

Sri P.S.Rajasekhar, learned counsel appearing for the said Housing Finance Limited, would inform this Court that the owner of the premises settled the loan account to the extent of 95% of the outstanding dues in terms of a one-time settlement and sought leave to clear the balance dues in W.P.No.24513 of 2017 filed by him. Learned counsel would further inform this Court that in terms of the order dated 26.02.2018 passed in the said writ petition filed by the owner, viz., W.P.No.24513 of 2017, the balance amount has also been paid and the loan account itself stands closed.

In that view of the matter, the grievance of the tenant with regard to the proceedings initiated by the Housing Finance Limited under the SARFAESI Act does not survive for consideration at this stage.
