THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3169 of 2016 ORDER:

This Criminal Petition is filed by the petitioner under Section 482 Cr.P.C., seeking to quash the proceedings in Crime No.699 of 2015 on the file of the Women Police Station, CCS, DD, Hyderabad. The offences alleged against the petitioner are punishable under Section 498-A & 406 IPC and 4 & 6 of the Dowry Prohibition Act. The petitioner submits that he was arrested in the Rajiv Gandhi International Air Port on 09.06.2016 and his passport was seized by the police and subsequently, he was released on bail. He further submits that he got a job in USA and if he failed to join in the said job, he will lose the same and hence, he prayed for a direction to the police to return his passport.

Heard and perused the material available on record. After hearing the arguments of both sides and after perusing the material available on record, this Court is inclined to pass the following order:

The petitioner is directed to approach the Court below and file an application for return of his passport. On such application being filed, the Court below shall consider the same and pass appropriate orders and if the petitioner is aggrieved over the order, if any, passed by the Court below, he is at liberty to approach this Court. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J March 11, 2016.
