THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11870 of 2025 ORDER:
Seeking the Court to enlarge the petitioner-accused No.1 in S.C.No.331 of 2023 on the file of the learned II Additional District and Sessions Judge, Medchal-Malkajgiri District at Medchal, on bail, the present petition is filed.

Heard Sri P Vikasraj, learned counsel appearing for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 3.
Learned counsel for the petitioner submitted that the petitioner was convicted for offences punishable under Sections 302, 379, and 201 read with Section 34 of the Indian Penal Code (IPC) and that the petitioner was arrested pursuant to the execution of a Non-Bailable Warrant (NBW) issued by the trial Court and was produced before the Court on 25.04.2025. Since then, the petitioner has been in judicial custody. He further contended that the petitioner failed to appear before the trial Court only on that particular date and that the trial is currently at the stage of examination of PW.1, with 27 witnesses yet to be
examined. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition. 4.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner and submitted that the crime pertains to the year 2022 and the Sessions Case was registered in the year 2023. Upon instructions, he submitted that the petitioner was not produced before the concerned trial Court on the relevant date, and hence, prayed the Court to dismiss the criminal petition. 5.
In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioner was arrested on execution of the NBW in April 2025 and has been in judicial custody since then. As seen from the record, the trial Court is presently at the stage of examination of PW.1. Considering the circumstances and the stage of proceedings, this Court deems it appropriate to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.10,000/- (Rupees Five Thousand only), with two sureties for a like sum each to the satisfaction of the
learned XXII Additional Metropolitan Magistrate, Cyberabad at Medchal.
ii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
