THE HON'BLE Dr. JUSTICE G. RADHA RANI CRIMINAL PETITION NO.9845 OF 2021 ORDER:

This criminal petition is filed by the petitioner/A-12 under Sections 437 and 439 of Cr.P.C. seeking to grant bail to him in connection with Crime No.157 of 2021 of Central Crime Station, Hyderabad, registered for the offences punishable under Sections 419, 409, 420, 465, 467, 468,471 read with 34 IPC.

The facts of the case in brief are that, the Branch Manager of Chandanagar Branch, Canara Bank lodged a report before Police on 30-9-2021 at 4:30 PM alleging that Telugu Academy, a department of State of Telangana, Himayathnagar, Hyderabad had been regularly opening Term deposits (FDRs) accounts with Canara Bank since February, 2021. On 27-9-2021, the bank received a letter dated 24-9-2021 from Telugu Academy along with 6 FDRs for redemption/closure before maturity. On such plea, the bank verified the records and found that 3 deposits amounting to Rs.19.00 Crores each were already closed on 22-9-2021 and funds had been remitted basing on the application and original deposit receipts submitted by Telugu Academy on various dates. The 3 other deposit receipts which were submitted by the academy on 27-9-2021 were found not genuine.

The bank observed that all the 6 deposit receipts submitted by the academy on 27-9-2021 were found not genuine. They were fabricated and some discrepancies were found in the signatures of the bank officials, seal of the bank and difference in amounts and figures, rate of amount, period of deposit etc. Basing on the said report, the above Crime was registered.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondentState.

The learned counsel for the petitioner submitted that the petitioner was granted bail in the other two crimes alleged against him in Crime No.153 of 2021 and Crime No.154 of 2021 on the file of PS WCO, Team -XII, CCS, Hyderabad, he was innocent of the alleged crime, police had foisted a false case against him, the petitioner was in custody since 9-10-2021, he was willing to abide by any terms and conditions imposed by the court in the event of granting him bail and prayed to enlarge the petitioner on bail.

5. The learned Additional Public Prosecutor opposed the petition.

6. Perused the record. The only allegation against the petitioner, arrayed as A-12, was that he was a loan agent and while transferring/depositing the FDRs, he had taken Rs.5.00 Lakhs. Considering the same and that he had nothing to do with the misappropriation of crores of rupees and that he was already enlarged on bail in connection with Crime Nos.153 &154 of 2021 on the file of PS WCO, Team -XII, CCS, Hyderabad on 17-12-2021 by this Court and this case also stands on the same footing, it is considered fit to release the petitioner on bail subject to certain terms and conditions.

7. In the result, the Criminal Petition is allowed and the petitioner/A-12 is directed to be released on bail, subject to the following terms and conditions:

(i) The petitioner/A-12 shall be released on bail on his executing a personal bond to a tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate, Hyderabad.

(ii) The petitioner/A-12 shall personally appear before the investigating authorities on every Sunday between 08.00 AM and 11.00 AM for a period of two months or till filing of the charge sheet, whichever is earlier.

(iii) The petitioner/A-12 shall not interfere with the investigation, intimidate or induce the material witnesses and shall co-operate with the investigating agency.

(iv) The petitioner/A-12 shall not misuse the liberty granted to him.

(v) The petitioner/A-12 shall personally appear before the Court concerned on each date of hearing till conclusion of trial.

Miscellaneous applications, if any, pending, shall stand closed.
